Got hit by a mailman

I was about to cross the street and the mail lady saw me, she was making a right turn... I get infront of the truck and she hits the gas and i get pinned into the ground and her truck. I felt fine and my bike was fine so I left... I get to work and then i notice a big scrape on my arm, and my shoulder is a little sore. I called the post office to see if i could get her number, they said she had reported it, and "i left the scene of the accident which is illegal" now cops are going to be involved.... I'll see what they have to say. I dont know if I can do anything about it, like sue them.. I really dont want any trouble, or sue them unless I can get $1,000,000.

They're insured up the ***. If she's determined at fault, their insurance will settle pretty fast. Get yourself patched up. Get a new bike. Their union is strong. She'll be put on admin duty for a while getting paid to do office work. Who knows, if she gets in enough accidents, she may make postmaster (this is how another bay area USPS employee got their job, but shhhh...it's a secret.) Maybe you can just get USPS to give you an old trek5900 they've got lying around.

What kind of intersection was this? "I was getting ready to cross the street and she was making a right turn.."

Were you riding your bike in the crosswalk/on the sidewalk? Going the wrong way down the street?

Were you riding your bike in the crosswalk/on the sidewalk? Going the wrong way down the street?

I was going against traffic on the sidewalk because my work is on that side, since I was like a block away from work. It was a T intersection.

Now the cop said its my fault because i was riding against traffic on the sidewalk. So if im driving a car and saw someone riding at me I can hit them and be ok.

My friend/ bandmate is a mailman. Their union is pretty hardcore, but if she were found to be at fault she'd be busted down for sure. If I remember correctly they are self-insured. Maybe that's why the price of stamps goes up every 6 months

File a police report regardless of who is at fault. The police report is the basis for anything else that will happen.

that totally is your fault. i mean, i'm glad you're ok, but stay off the sidewalk. on second thought, do what makes sense, but be careful doing it. i know i'm on the sidewalk at every stop, but if get hit being a bonehead, i'm not gonna get mad. but then again, you don't sound mad. so, all's well that ends well and good luck.

Word. Drivers aren't looking for things going at more than jogging speed on sidewalks. The only time I ever got hit was when I was riding on the sidewalk.

Glad to hear you made it, thats what really matters... considering that you have not lost any time @ work, or sustained any injuries to your body that may possibly hamper your future work capabilities or mental state, you really have almost no damages to claim? Of course, some slick lawyer may disagree with me on this one ! LOL

I've had 2 many close calls one the sidewalk, and just about as many on the road ... but it seems like the sidewalk near-misses were always more dangerous to me !

+ I am much faster on the road than the sidewalk...

1) You left the scene
2) The Police said you were in the wrong
3) You already have a DUI ticket on your bike

Could look ugly in a court...
