Bikes: GT zr 1.0, schwinn

another cyclist ....

i heard today that another cyclist got hit on 3rd avenue (?) around 16th or so. i think he was hit by a truck and killed on the spot. he was a food delivery man. this was late last nite (friday). if anyone heard anything different let me know.

Almost every food delivery guy I see doesnt have any kind of visibility at night. No reflectors, lights, nothing! If i'm riding my bike and I cant even see them I can imagin a truch or car. Dumb ****s, dont be stupid, make yourself seen at night!

Ya, true, it's hard to see some of these delivery guys at riding at night. i hit one of them on my bike... he was almost invisible, no lights or reflection of any kind and black cloths on!

restaurants need to start being held accountable for the safety of their delivery guys. they should be required to provide front and rear lights at the very least, and i think they should also be ticketed for their riders riding against traffic and on sidewalks.

I agree that restaurants should supply their delivery guys with things like lights, but I am not sure about having them ticketed for moving violations committed by their delivery guys. Do messenger companies get ticketed when their messengers ride the wrong way, run red lights, etc.? How about companies like UPS, FedEx, etc.? Do you feel they should get ticketed for their drivers moving violations?

They should be. It would probably do more to ensure that professional drivers drove safely then anything else.

Unless the store owns the bike I see no reason why they should be repsonsible for lights etc. They wouldn't own a driver owned car.

the ticketing the employer thing, i admit, is dicey. still, companies that promote rush delivery and do commission based pay are encouraging getting things delivered quickly whatever the cost. paying an hourly wage would discourage this as well.

and pizza companies/other companies that pay delivery drivers and couriers who use their own cars often pay for gas in addition to wages, so i don't think asking companies to pay a little extra to make their delivery people's job a little safer is unreasonable. many/most of the food delivery people in NYC live WAY below the poverty line so paying $20 for a light is a lot to ask of them, where as it's hardly anything to ask of the employer.

Two words (latin for fun)--Respondeat Superior

By all rights, the employer should be on the hook for lights, moving violations, etc. They don't give the UPS drivers parking tickets, those are the responsibility of UPS. And they sure don't let pizza delivery guys drive cars without proof of insurance.

Traffic tickets on a company owned van != moving violations.

They do let pizza delivery guys drive with busted out light and any tickets incur from doing so would be thier own responsibilty since maintaining thier own car is. Non-megachain drivers are often hired without insurance and even pizza hut et al don't check to make sure it is kept current.

NYC streets are like the wild wild west. cars do what they want and so do cyclists. If it werent for red lights the streets would be like Mad Max Road Warrior out there. Riding defensivley is the only way to stay safe.
