Leaving the scene of an accident is at least a traffic violation, if not a criminal misdemeanor (if you had been seriously injured, it could rise to a criminal felony). I suggest you press charges against this a$$hole. That should probably also have the benefit of making it easier to collect from his insurance company (it's a lot harder for them to argue that the accident was your fault when their insured driver fled the scene).

If you can find witnesses, that helps as well. Good job chasing him down. Good luck and keep us posted.

Glad you caught the moron and there's going to be some repercussions coming to him out of this. I had somebody intentionally try to hit me on my way home last night.

when michele got hit and i caught the guy he got cuffed and brought in for the night but i think that was mainly cause he was driving with a suspended liscense.

Get witnesses! these kind of things are brutal to prove and require evidence that he was driving the car at the time. Its really hard to bust drivers on this kind of thing.

If there are no witnesses, admissions, or evidence linking the driver to the vehicle involved in the "hit", then the "run" could prove successful.

Ah, but that is the best part. Two guys were hanging out at a quick stop on the opposing corner and saw the whole thing. I got names and numbers and they're willing to do whatever.

I took the frame in this morning. The rear stays are bent and it tracks to the right. When the reporting officer gets on duty tonight I'll be talking to him and see what happens next.

if the guy was arrested try and find his insurance information with the police department. make a claim directly with them. if the frame is bent, it counts as being totaled. bent seat stays equals buy your ass a whole new bike.

maybe............if we living in the 1420's and people were still using ducks to detect witches.

if you own a car, you are responsible for its actions, even if you are not driving it. if the owner denied being the driver, unless he can give the name of someone who was responsible, the burden will fall directly back to him/her regardless.

I was speaking in reference to several instances where I know the cases were dropped due to dishonesty (they lied) on the drivers part. They were still held responsible for the damage incurred, but the prosecutor decided the odds were not in favor of pusuring the hit and run charges.

The fact that the OP spoke to the driver and could probably pick him out of a line-up means that there is very little chance of the driver getting off. Unless the guy driving wasn't the owner of the car. Then things could get more interesting.

Luckily he has witnesses. If there were none, and if the driver denied the verbal exchange, then it would have been interesting in a different way. I'm speaking of the H&R, not the property damage.
