My 100 dollar lesson...

in an accident definitely call the cops. I lost an entire month's work & time off the bike, because of an injury that didn't reveal itself until the adrenalin wore off. I went to the police station with the driver's plate numbers, but they told me that by this point it was just my word against theirs :/

I sent the guy an email threatening to get a lawyer yesterday, and this morning he said he took care of it. I don't want to leave it with so much hostility, so I'm going to send him a letter telling stating that I didn't incur any injuries in the accident and that I have no intention of suing. He said he was hesitant because his insurance company told him not to pay it (that would be an admission of fault for the accident). WTF, insurance company?

unfortunately i think it's widely known that US insurance companies are definitely bottom of the barrel when it comes to scumbags. right down there with slumlords and dishonest apartment brokers.

True, but they ain't UNICEF. Gotsta bring in da dollaz somehow. If the cops would have been called, insurance would have more than likely paid.

You might have better results filing a small claims lawsuit. It may be difficult to collect, but it might also get his (and his insurance company's) attention. If he doesn't show up to defend, he loses by default. Art. IV, sec. 1, of the US Constitution makes a judgment from your state enforceable in his. How much time and energy do you want to expend on this?

It places you in a legally vulnerable position.
You want to be the person in charge of this situation.
Keep it that way by saying nothing of the sort.
