Most of the time, there ain't a snowball's chance in hell your little earbuds are going to make you not notice an emergency siren, and the cop will have a very hard time proving he had probable cause to believe you couldn't hear an emergency siren unless there's a no headphone law in your municipality. which there may be. which is why you get speakers.


similarly, i usually don't wear headphones but i very frequently play music aloud on my phone with it right next to my head. this is not illegal and it's also not in the least bit dangerous.


can you imagine the collective havoc that would ensue from the lawsuits of deaf organizations and individuals were such laws about listening to music rather than blocking out sound?

SOUND HAS NO BEARING ON TRAFFIC SAFETY. that's why emergency vehicles have lights, and that's why it's illegal to honk your horn in a non-emergency situation.
I believe it was compared to drunk driving because of the irresponsibility of those who drive while drinking versus those who use giant headphones while riding.

BTW I actually agree that it's cool to listen with small headphones but I've seen waaay too many hipsters and ******s riding with huge skullcandy headphones that are clearly made to drown out sound. I own Sennheiser headphones where I can't hear **** even when I don't have music playing, I don't understand how someone could ride safely with them actually playing music.

Hearing is quintessential necessity in New York City no doubt.

plenty of deaf people do it every day and they do it safely, lawfully, and in spite of your ridiculous notions.

yes, plenty of hipster **********s wear stupidlarge urbanoutfitter dj headphones... but they do that while standing, shopping, sitting, eating, pooping, partying, posing, riding the bus, and having sex(presumably) and it's dumb for all the same reasons then during those activities as it is dumb when they ride bikes, without exception and for no other reason when they ride a bike because YOU DON'T HAVE TO HEAR **** TO SAFELY OPERATE AND CONTROL A VEHICLE ON PUBLIC ROADS.

Peace to the deaf but that's totally irrelevant and the argument that "if the deaf can do it.. so can we" is almost laughable. Particularly when we're talking about people listening to music while biking. Surely plenty of blind people walk the streets of Chelsea safely and can cross 6th avenue without a problem.. but I wouldn't assume that you nor I could do it the same. I believe if deaf people were riding bikes in New York that they'd probably be a lot safer than everyone else. I guess you can make the point that if you ride in a relaxed manner without rushing in traffic that you could definitely listen to Senheisser's without a problem and I'd agree. But I think a lot of us are talking about people riding in speedy traffic, rushing lights, and weaving in and out of cars with DJ headphones on.

I disagree. But then again I actually ride 25+ miles through New York City traffic everyday.

Now you're just assuming I think it's okay to drink and drive.

Riding with music blocks the person's ability to listen to potential threat in traffic; while drinking-and-driving impairs judgement and all of the sense and IS a threat to others. It can not the be compared to drinking and driving because it is unlikely a cyclist is going to kill another person by riding with headphones. Sure, the cyclist may kill himself, but it is their decision to listen to music.



We can argue about this all we want, but no one is changing nobody's mind and this is going to get nowhere.

A&S already have a thread about this subject and it probably best to shut this thread before it gets even more out of hand. If anyone wants to argue some more, please go to A&S.
