Glad to see that the person who hit the cyclist is speaking with the police..at 11 pm it is highly likely that Alcohol and or drugs might have been involvled.....RIP Ric!

I'm sure she will say she had no idea she had hit someone, so it will just be an "accident". No charges, no fine, no jail, no problem.

You know, maybe it's just me, but if so many drivers are in fact "panicking" after a collision, wouldn't you think this is a sure-fire sign they are vastly under-trained?
Flying a plane is more complicated, and in many ways should be more dangerous. But strict training and regulation ensures it's actually much safer. While it happens, pilots are trained not to panic, and don't often.
Regardless, panicking at the time is not reason to not call when you get home, or to return to the scene.

They'll drop the hit and run charges since she came forward voluntarily and she won't face a DUI since they can't prove anything. She and her passenger will also claim the cyclist "swerved" and since there seem to be few witnesses, her story will be the official one..

Or she will say that she never saw him when she probably did. But the police will accept that excuse and, not look to see if she would be lying.

Yup, I think it's probably a DUI, and the driver did exactly the right thing to get off. She'll get a minor traffic ticket, or none at all, and perhaps a few hours of community service. And in a few months she'll be behind the wheel drunk again.

Yup, for some reason people see a curvy road with poor sightlines and think "road that cyclists shouldn't be on" rather than "road cars should drive 30 MPH or less on." Nobody pays any attention to leaving safe stopping distances, examining sight line distances, etc anymore.
People think that the speed limit should be however fast they can get their car up to and still keep the wheels pretty much on the road, and if they hit something it's not their fault, it shouldn't have been there on "such a dangerous road" in the first place.

I would think the best they will charge her with is leaving the scene of an accident and failure to render aid.

I lived in Las Cruces for fifteen years until relocating three years ago. Like many communities, its acceptance of cycling is hampered by class perceptions of cyclists. Several years ago a cyclist was killed in an early morning accident on Telshor Drive. Nothing was made of the accident since he was a seeming "indigent." I'm hopeful that more may be made of this incident insofar as the victim, although not "middle class", was clearly a "valued" member of the community with family. One can only be hopeful that at least a few eyes are opened by this tragedy.

The cyclist is just as dead if hit by a reckless teenager than a distracted old fool. If the police continue to treat Motor Vehicle Homicide as a petty offense, drivers will never learn.
The local cycling community needs to take a page from the MADD playbook and hound the police, prosecutor, and courts with all the publicity they can generate.
The media WILL cover any demonstration with 30 or more participants. Use the internet, picket the police department and the prosecutor's office space. Pack the courtroom.
Talk to the press, the radio people, and the TV folks. Use political ACTION and EMOTION (show the family, distribute photos, humanize the deceased cyclist). It works.
If MADD could do it, cyclists can.
This should be done in every location, every time a cyclist is killed. Stop whinning on the internet and put a stop to leniency for these KILLERS. Call them what they are -- KILLER, not murderers but ordinary, garden variety careless, negligent, reckless KILLERS. And demand appropriate punishment for their HOMICIDE. This was not an "accident."
