Yeah, but I think the seller thinks that he can just use the photos from Scott's blog, but that's Scott's bike. Who knows what the seller's bike actually looks like. Condition is everything in used bike sales and purchases.

If the photos aren't used with permission then that opens the seller up to being sued for a fee and/or cut of the profit. It's precisely the thing "fair use" doesn't cover. Fun =P

The components alone are worth nearly double that on ebay - if it's a full 600EX group with cranks. Whoever is near this should pick it up ASAP.

That's the reason I post so few new pics........

Curious about this part. Pardon my asking, but what loss have you experienced as someone who has images of their bike taken and used to sell another bike? Do you take fewer pictures of your bikes for fear that other people will use them maliciously?

Hmm...I'm not sure about that one. Fair use might actually cover the copyright end of this seller's actions, unless the offending party was selling the images or was somehow causing loss (financial, emotional, otherwise) on the part of the photographer. Misrepresenting an item in an eBay auction is a no-no, and shouldn't be allowed. But at the same time I don't think you'd get very far suing someone for a portion of the profits they received when they used your photos to sell a single product in an online auction.

I assumed it was his bike pictured for sale but did not mention his name, seems odd such a long standing seller would use some random photos.

It's okay, I'm certain of it. We once used a fan's photo of our booth in an advertisement to announce pre-orders and drum up hype for our game and it was a very swift legal lesson. It was literally the same situation, a photo from a blog, but unlike this, the photo was actually of our product... this doesn't even have that merit. So long as you're using someone else's photo in an attempt to sell something it's not Fair Use. No, you won't get far with this eBay nonsense, but it's enough to be a pita if you have the means to do it, that's all I'm saying.

Just looking for a little more privacy in my old age.

I still meter out a few things, but I recently blocked an entire section of my Flickr account.

I usually couldn't care less if someone posts a pic for non-commercial use.

It's just more than a little eerie when I see my bike for sale in Hungary or Sydney.

On the other hand, I'm not much of a picture guy anyway.

It's really a matter of right or wrong isn't it.

Why do we have to resort to "suing" someone for a share of profit, when we should really understand on a basic level it is fraud/misrepresentation.

Ok, ok, enough speculation on this Opus!! It IS his bike! That WAS my Fuji, the seller did ask for permission to use the photos, he is a C&V member. He bought it from me last year. It's a fabulous bike, one of the nicest Fuji's I've ridden. I regretted selling it, I'm sure the current seller will have regrets too.

Timmy T was kind enough to check in with me as well, I was just able to respond to him a few minutes ago.

BTW, way too many negative assumptions were made discussing this ..
