Merida cyclocross tire clerance

I have the Merida cx 600 bike and I'm wondering how big tires I can put under the bike.

The guy at the merida store told me not go bigger than 38c but does anyone know if you could fit 40c like WTB nano?

keep in mind that if you ride at a lower pressure, any given tire will measure less in width. meaning if you mount a 40 but run it low, it might only measure 38
