If you are hit by an insured vehicle, unless you live in a no fault state, you can expect their insurance carrier to pay for your injuries and damages. Unless there is a huge question of liability, most insurance companies would rather settle with a cyclist or pedestrian than have the injured party get representation and possibly file suit. And if you're not seriously injured, I suggest you don't hire an attorney. The average claim payout increases by a large amount, but some pittance like $100 more is all the ends up in the injured party's pocket. The rest goes to the attorney.
And you are right about the attorney (lawyer) as I got $8,000 and they got $25,000.
But then again the insurance company drag it on rather then settle which took years maybe it had something to do with the police blaming me I don't know.
