AH thank you so much!!! I went to check the spacing and the chainline, but no FW yet. I decided to torque the crank and remeasure.... then I noticed it, the chainstay is CRIMPED!!! measuring to the tube it is still about 4-5mm but if the tube was not crimped it would be about 2-3mm.

thank god I don't think I could take another issue with this project.
