I think this is even more important to safety than the 4-foot buffer. On the narrow 2-lane PA road that's part of my daily commute, most people have no problem crossing the double yellow to pass me, but occasionally someone will try to squeeze through, even with no opposing traffic. And, frankly, I've scanned the PA vehicle code for explicit permission to cross the double yellow, without success. I'd be happy to see this "clarification" in the code.
Florida is the only state that I know of that specifically spells out the permission to cross center lines when safe to pass a slow moving vehicle.
Maybe try the slow moving vehicle traffic code to see if your state spells out the same.
