Right away that cancels out the big lie that the driver didnt see me, and since I an wearing a helmet, the facts of an accident starts nearer the truth.

For a non-helmet wearer, besides the hole in your head and the concussion, or worse, you will likely get short shrift in pressing for injury compensation. You will look like you lack a certain amount of common sense. Like someone who refuses to wear a seat belt.
