+1 in my estimation both are at fault seller for not honoring the the agreement and buyer for jumping in.
I am a firm believer in the old saying "do on to others....".
I have been disappointed to hear I am 2nd in line but never said I can be there sooner or "I'LL" pay you more etc. I can understand that some buyers might say that they will be there yada yada yada and never show up so sellers might loose a sale because they have informed other buyers that someone is on the way only to have them not show. This may cause others to wonder why the item did not sell and move on or pass..
Sellers should never say they will hold if they won't and buyers should never swoop.
I sleep good at night.
