The CFR reg you noted is just what specifications an electric bicycle must meet to be classified as an "electric bicycle." The states make the decision as to when Electric bicycles are allowed on paths designated as "motorized vehicles prohibited."


Washington State is an example where "electric bicycles" are allowed on multiuse trails and bikelanes. However, they are NOT allowed on trails specified as "motorized vehicles prohibited." This includes sidewalks.
