that's sucks.. my company is merging too... already had 1 layoff .. now the big cheesers are fighting for their spots and then I assume another layoff coming after that. I'm in the red headed stepchild side of the equation, so not looking swell despite the fact that we bought them.

2015 Cannondale SuperSix EVO Team Edition size 60 any chance this is a recently retired pro's bike? Same person also appears to have a cross bike.

I'm pretty sure merlinextraligh will be fine. I've seen his garage door, I think it's worth more than my entire condo.

Thanks everybody. I will be fine. I get some severance, my wife has a good job, and I could retire if I wanted to (but not in the style I would like).
I've got a one year non-compete I have to deal with, if I want to stay in the same industry.
I likely can do some of the same work in private practice that I do for my current company. That gives me some leverage if I want back in private practice. But starting up a new practice at age 56 is not a real appealing proposition.

That's what I was wondering too. Seems like it should only apply if you quit.

So my new boss just offered me his old Trek 2300 that he doesn't ride anymore, so I guess I have the commuter bike figured out!

I'm hoping to spend two weeks in NV, UT and AZ (maybe even SoCal) after spending Christmas in the Front Range area of CO.
Doing nothing but mountain biking, hiking, and stinking of smoke from sage/mesquite fires.

Hmmm ... first Halloween in new neighborhood. Bought gobs of candy to be a good neighbor. Kid visits = 0. Now, I need to not eat all the candy before giving it away at work.

Got yelled at by Rassan Bahati on a climb yesterday. Actually, he was encouraging me and I would have gone faster but there was a slower rider in front of me. (sure,John)
Later, on a steep section Tinker Juarez flew by us looking like he was taking it easy.

We probably got 400-500 kids. We take turns standing on the porch because it's constant from 6-8:30.

We did steady traffic. Toward the end it was the rowdy groups of kids (of the the same groups earlier in the night had pushed my daughter out of the way to get to a front door) who just said "gimmee candy" and then took off running through our landscaping without a thank you. I decided it was time to turn out the lights and call it even though we had candy left. My students will appreciate the leftovers.

I seem to be coming down with something, headache and sinus drainage. Exploring the effectiveness of Jameson's and honey on that.

But basically in most jurisdictions a non-compete that is reasonable in scope, both time and geography, and narrowly tailored to what's necessary to protect the employer's legitimate business interests is enforceable. It has to be supported by consideration, but that consideration does not have to be severance pay equal to pay for the length of the non-compete period.
Unfortunately, mine is a one year non-compete, with only six month's severance.
I've got a lot of arguments why its not enforceable.(ethical limiations on enforcing non-competes against lawyers, lack of consideration, overbreadth etc.) Part of it depends on what state's law applies.
I could spend a lot of time and money litigating it. I'm hopeful that I'll end up doing something that my current employer doesn't care about, and we'll negotiate a waiver. They've already offered to send me business if I go back into private practice. So doing something that doesn't implicate the non-compete is a much better option than buying a lawsuit.
Or I can just wait a year, ride a lot, and tell my wife sorry, I've got to wait out the non-compete!
