If the car had come to a braked stop, and Shiek was following so close he couldn't safely come to a stop behind it, then he'd be at fault. But the car very likely came to a much quicker stop than it could have using brakes instead of van as stopper; there's no reasonable way he could have anticipated such a stop; he's not at fault here.
