I think you're blowing this out of proportion. No one is literally dictating or policing here. It's merely advice for those who seek it. You're right that in a democracy you can't legislate against actions that don't harm others---people are entirely free to do whatever stupid thing they want to their own property. But you can't legislate against criticism of stupidity either.

Furthermore, I think it's simply un-neighbourly not to let someone know when a particular course of action that may seem attractive is in fact a bad idea that they will come to regret---particularly in a place like an online forum that is based around the giving and receiving of advice.
