I think Salsa had something to that effect a couple years back. I can't seem to find it, but the rack side rails sat below the top of the tire like that
Edit: after a bit of research, it wasn't salsa. It was trek, and found on the Conduit+

Strange design. I often appreciate the fact that I can tie something to the top of the rack with bungee cords without having to use the bags every time. When the rack doesn't clear the top of the wheel, you can no longer do that.

There are a few very minimalist racks out there.
If money grows on trees, then look at some of the Beckman panniers/racks.

Some of the VeloOrange racks are quite nice too, some of which go well with racks.
