Stick with it through Paypal and eBay. I used to pay via bank deposit as my default, but now use PayPal exclusively for these sorts of reasons.
Well, I am most disappointed at PayPal's Resolution.
Here is how things went;
Jan 6 Contacted PayPal by phone. They put me on hold for 12 minutes while they discussed what to do on their end.
They then demanded that I go to the Police and have a Police Report generated. I have 10 days to fax a copy to them or the case will be dropped. I was absolutely furious. First of all it is now almost 4 weeks since I received the empty box. When were they going to demand this action from me if I had not called for follow-up? After all, they said they would contact me. I had to contact them! They claimed that it was PayPal policy to have a Police Report. Why was I not told that right away? Who are they to now give me a 10 day deadline when they made me wait so long for nothing?
Jan 15 Went to the city central Police Station with the empty box complete with packing peanuts. Spoke to a Constable. He refused to generate a Police Report. He claimed that it is only my word against the seller's and nothing could be proved either way. In any case, I had waited too long to report it. He said they get complaints all the time about Ebay and PayPal with similar scams. It's "Buyer Beware" !!
I asked for his card with his badge number so that I could prove that I was at the Station to request a Police Report to PayPal.
I went home to call PayPal and inform them.They accepted the Police phne number and badge number of the Police Officer over the phone. They claimed it was not necessary to fax the card to them. They claimed that they would contact the officer to speak with him.

Jan 16 PayPal emails me this
Our records indicate that you never responded to requests for additional
information about this claim. This claim has been cancelled, we hope that
you have worked out this situation amicably with your seller.
I call them and get an appology immediately I get another e-mail that says this;
Please disregard your previous email as it was sent in error. Your case
will remain open and worked as normal. We apologize for any inconvenience.
Jan 17 PayPal e-mails me this,
Unfortunately, in order to continue this investigation, a police report
must be filed with your local law enforcement agency and a copy of the
report must be faxed to PayPal.

Contact your local police department and obtain a police/incident report.
This report should be on the law enforcement agency’s letterhead or stamped
police documentation and clearly explain the details of your issue. This
documentation must include the department/officer’s contact information,
the reporting officer's name, badge number and signature.

If the upload feature is available in your PayPal account, we encourage you
to upload your documents, as it’s usually the quickest way for us to
receive and review your information.

Here's how to upload your information:

1. Log in to your PayPal account.
2. Click “Resolution Center” near the top of the page.
3. Click “Resolve” under “Action” next to the item for which you need to
provide documentation.
4. Follow the instructions to upload the files.
5. Click “Send Files to PayPal.”

You can also fax the police/incident report to PayPal at (402) 537-5760
(please note this is a United States phone number, if you are faxing from
outside the United States, you will probably need to dial 00 1 before the
number). The fax needs to include your email address and PayPal Buyer
Complaint Case number<DATA REDACTED>.

We need to receive your fax by January 18, 2013. If we don't receive your
fax by January 18, 2013, your claim will be canceled. Please note that
we’re unable to grant extensions to this time period or reimburse you for
any costs or fees related to the requested documents.

Note: Any documents you provide may also be supplied to the seller.

We regret any inconvenience this may have caused. Thank you for your
patience and cooperation.

I don't go on the computer everyday and was working 12 hour shifts all weekend.

Tuesday Jan 22nd, I check my e-mails.
Unfortunately, we couldn’t process your appeal because we didn’t receive
the documentation we requested within the specified timeframe.

We encourage you to work directly with the seller for further resolution.

Thank you for your cooperation.
I think that I will contact the Police Officer on the card and see if PayPal had ever contacted him. If not I may take PayPal to small claims court for defrauding me.

I had bought a frame on ebay and it was shipped Fed Ex. The box arrived in perfect condition and I thought it was empty as it felt just like an empty box. I opened it and sure enough the frame was in there, no packing material at all. It was just loose in there and absolutely perfect. The Fed Ex shipping was flawless. I don't think UPS is as good as that.

I think you should talk with the Constable's supervisor and escalate it higher and higher as needed to get a police report. The police take reports of "he said, she said" every day. This Constable is just being lazy, if they only generated police reports with enough evidence to convict they'd have no unsolved cases.

I feel that I should not have to go that route.
If it was PayPal policy and standard procedure, then why did they not ask of that immediately?
Why the games of making me wait and then only ask for a Police report when I contacted THEM again enquiring about why such a long wait?!
I believe that PayPal and Ebay want the sale to go through so THEY get their commission.
If I would get my money back both PayPal and Ebay would get NOTHING
For them to be the arbitors of a dispute is a conflict of interest
I have a 100% FEEDBACK score, but apparantly that does not mean anything even though the seller only has 97%
It is not so much the amount of money as it is the principle. I feel cheated AND labelled a liar by insiinuation.
I have moved a lot of money in transactions with PayPal.
This amount I am being cheated is like a little over 1% of all the buisiness they have had with me.
I'm disgusted.
They should have done more for me and treated me like a valued customer.
How am I to procure vintage bicycles and parts now how do I make payment over the internet?

Small claims court. It would be pretty easy for a judge to look at that and award you a proven value.

Having worked for a courier service, that is purely by accident. This time of year, courier services are no where near as busy as they were a month ago, guys loading and unloading planes and trailers, actually have time to look at a piece of freight, so if it says fragile on the box, they will put it to the side and either end or top load it at the end. A month ago, stuff was packed in until they got to the door strip, every box becomes a blur the trailer pickers see a postal/zip code and little else, your bike could then end up holding up 500lbs of freight.

Sounds like you should never use couriers for the 2 months before Christmas, Ok for the other 10 months (unless you make the package bomb-proof)
