What should I do?

My speedplays just came today. Tell me what you think about this. I bought them off E-Bay from a guy who said they were "new" still in the box. I paid $99 for them, not including the cleats. Yes I know, I got ripped off. I just got them today, and they are not new. They were in the box, but they were not unopened in the original package. They appear to have signs of wear. Granted, very light wear...but it seems to me that they had been "clipped into" before. What should I do?? What did your pedals look like brand new? These have some scratches on them. I wouldn't think they'd come from the factory with scratches. I just really feel like I got screwed over.

While I'm sure the pedals are in good enough condition to ride in(you did say very light wear) I would try to get my money back.

Just on principle. The seller said they were brand new in box, so they should be brand spankin new in box.

I agree. Get your money back. Then AFTER you get your refund, I would give him negative feedback. That is really bad business practice.

You're really not having much luck lately, are you? I agree, though.. I'd get a refund and go to the bike shop and buy my pedals. If I buy pedals & shoes from my LBS, they'll throw in a free cleat setup on that special little bike with the special pedals.

Definitely contact the buyer today and inform them that these speedplays are NOT new, and point out the false advertising in the ad they used for ebay. Tell them you want a refund immediately, and they should also pay for the shipping (try to get them to do a COD so they pay for it on their end).

Do save the ebay listing with a copy-paste, or do a print screen option and print out the screen. You may get lucky and get a refund right away, but if you don't, the listing may disappear with expiration, and then you'll need further proof. In that case, you can pull out the ad from wheny out printed out the screen.

Then go to the LBS and get some new ones.

I'm curious, didn't it show a pic of the speedplays in the ebay listing? You would have seen the speedplays, I would think.

Depends on how much aggrivation you want today... if you want to stand on principles, do what the above people suggested. They guy lied and should have his feet dipped in cooking grease.

If you're not too unhappy with the price and condition -- eventho it's not as advertised -- just ride them.

Make sure there was no mention of them being used in the listing. I say that, because my son recently paid about the same for a set of slightly used Speedplay Zeros on eBay. Hell, you will have more scratches then they have now a week after you use them. They will last forever if you are sure to grease them every 2000 miles through the little access plate on the side of the pedals.

I would contact the seller if there is no indication of the fact they were used, and ask how they justified sending you used pedals without mentioning said useage. Perhaps they will make a financial adjustment. Which model did you get? You still may have a reasonable deal even though they are slightly used.

They could be a "floor demo" and have never actually hit the roads. Do you have a picture or the item# on ebay?

BTW...the pedals shown in the picture are not the ones he sent me. The ones in this picture have a sticky tag on the side and look brand new. The ones he sent me even have scratches by the black part of the pedal and you can see the metal under the black paint!! I'm gonna see if I can get my money back. Jerk.

Don't expect too much - he has several feedbacks for similar issues and even people who left him positive feeback complained that he doesn't answer e-mails. When one buyer complained about the size of an item his response was "you too fat, lose some weight!!!!!!!!!!" Nice attitude...

Edit: the problem with sellers like this guy is that at first glance they do not appear too bad - he has 15 negatives but 2888 positives. Reading the neutrals gives a slightly different picture as most of them read like negatives. Also he has at least 3 feedbacks where buyer and seller slammed each other and later agreed to withdraw the negatives. Attitude that comes through in his responses to people is pretty poor - doesn't sound like he ever accepts responsibility for anything and even people who got refunds complain about eating the shipping. Good luck - hope you used a credit card. If Paypal file a claim quickly - don't wait on this clown for a happy ending.

Wow...I should have read his feedback first. I sent him an e-mail. I doubt I'll get a response. I told him I wanted my money back because the item he advertised is not the item I received. Man that chaps my hide. I did pay through pay-pal. Maybe I'll get it resolved from them.

Nope... Paypal won't touch it. You received your item, so paypal will refer you back to ebay because it's an issue with the merchandise. Generally paypal will only refund you if you receive no merchandise at all.

If you get stick with the pedals, then definitely leave negative feedback, explaining that the product was used and badly scratched, when advertised NIB.

NIB means NIB, not "tested, but never ridden" or "used once, but put back in the new box". The practical side of me says that if there are some scratches that indicate more clipping than use, I might forego the hassle. However, the less practical (and larger) side of me says that this guy isn't getting over on me and his feet should be held to the fire on items he sells as "NIB". If you're willing to go through the added aggravation, get your money back - there's some indication that it won't be an "of course you're right, and here you are" transaction, but you never seemed like the "doormat" type. Good luck.

You can put a complaint through paypal and they will hold back the money on his account until the dispute is resolved.

I would wait until exactly 6 months (mark your calendar) and the day before leave him a super negative feedback, by the time he reads it, it will be past the 6 month window and he won't be able to respond

this way you avoid him giving you negative feedback. 6 months is a long time, but it will be worth it

I think I am with LordOpie on this one. Getting your money back and returning the pedals is a hassle for you too. I would contact him and try to get a partial refund for what you would have paid for them if you knew the real condition. That is of course as Opie said, "If you're not too unhappy with the price and condition."

Then give him bad feedback....

Honestly I would chalk up this sitaution as "lesson learned" and try to be more careful in the future. The guy was advertising incorrectly, after all NIB means NIB (keep in mind that NIB does not mean UNOPENED in ebay parlance), it simply means that the stuff is new. Anyway I'm sure you ended up with a fine pair of pedals and will get much enjoyment out of them despite the scratches. My current pedals look like hell with major scratching on them. Anyway I would not try for a refund as that would be a bigtime aggrivation, rather I would contact the seller and say

"I am contemplating a negative feedback becuase of XYZ problem. Unless you refund $XX I will leave a negative feedback. If you don't respond by XX/XX/XXXX I will leave the feedback. Thanks in advance for your response"\

People should not leave negative feedback carelessly. Good sellers will do almost anything to protect their feedback rating. Give the guy a chance to make amends before going negative.

This guy, with 3k feedback, obviously makes a living on ebay. If he's smart at all he'll want to make amends so that his rating is not negatively affected. After all maybe he shipped the wrong box, who knows. Maybe he's just an Ahole. Anyway enjoy the pedals I htink they're snazzy.

I am an ebay seller and I can tell you that you need to send the pedals back ASAP. Do it insured with signature delivery confirmation. That way you are sure to get yourmoney back from paypal... you have no merchandise... it's been returned, it wasn't as described. PP will give you a refund.
