I've been whacked on the ass by random babes more than once. I've always had quite the smile on my face for the rest of the day.
This chick whacked me on the ass in a tire store one day, and it led to wonderful things..... a prescription for Zithromax, for one.

Sure, it sucks that guys can't just smack women on the ass and expect positive results, but that doesn't mean that women are held to the same rule. Sometimes it's nice when chicks realize that guys don't really think that much less of them when they let us know what they want. Honestly, how many guys are really gonna complain about a little sexual harassment (against themslves!!), as long as they haven't repeatedly said "no?" Why the heck do you think there are so many SH cases against women? It's not guys trying to assert their dominance, it's 'cause they're thick-headed and stupid, and assume women have the same ideas as them, and are just "playing" lady-like.

Anyway back to the subject. I seriously doubt anything will happen to those kids. Maybe a slap on the wrist. I was assaulted outside 7-11 by some ******* I knew from high school. I got 12 stitches on my head. The guy who did it got elfin 2 year probation! You want to get even, wait a month or two then slash the tires on that overpriced shopping cart.

If I recall my Crim Law correctly, assault generally doesn't require contact; battery does. Shooting at someone and missing is assault - still a serious crime. Shooting and hitting is battery. They smacked you, so that's battery. Battery, for the same conduct, is generally more severely punished for obvious reasons.

Definitely press charges - if they'd startled you and you'd gone down, they could have run over you. This sh*t isn't funny.

PS - It's remarkable how much criminal law and procedure ends up on Law & Order. Sometimes it's better than law school.

No I do not, and I was raised to think that double standards are just wrong. Besides I am happily engaged and would not take kindly to some "chick" telling me that she wanted to nail me. I have worked in many a corporate environment and this type of behaviour has ALWAYS been wrong. I had a female employee reprimanded for just such nonsense, and I could have gotten her fired. If such boorish behaviour floats your boat, then so be it. I, for one, do not subscribe to such foolishness...so kindly, do not lump me into your Neanderthal way of thinking.

He didn't throw it - I saw the shoe/flip-flop in his hand.

It went like this:
I'm riding in the right most part of the right lane minding my own business. 20 mph or so 150 BPM, hot, humid.

All of the following happens in about 2 seconds: I feel something. Immediately think I must have gotten a flat so I put on the front brake and touch the rear brake just a touch. I see the car go by real close to me with hand and shoe out of the side window. Realize I was hit. Look at license plate and start to say it out loud over and over again. Unclip as fast as I can and stop. Rear end of bike goes off the ground about 6 inches. Feel stinging pain on left rear.

I figure I could take off and catch them because they're coming up to a stop sign in less than 100 feet. But that would probably involve fisticufs and I'd end up losing my medical license for beating the crap out of a 16 year old. Not worth it. Get my cellphone and realize I don't have the Sherrif's phone #. Check myself out. Nothing broken or bleeding. Ride about 10 minutes looking for them (don't know why - yelling isn't going to do anything) and at one point think I see them down the road and get up to 207 BPM and realize I don't want to kill myself so I'd better just go home and call the authorities.

If anyone in the Copperfield area of Houston is reading this (there are at least 10 different road bikers that ride in the immediate vicinity around here that I am not acquainted with) then watch out for this guy. PM me for details if you want.

Nope...outgrew that need a long time ago. Rule no. 1 with bars or clubs, if you're interested, get/give a number and call a couple of days later. It's always better to see someone by the light of day over a coffee or meal when you're both sane and sober.

You're joking, right? You really think a woman would be convicted? Not in *this* decade. It would be a miracle if I could even get charges filed. That's why they call 'em double standards. Not that I really cared. In the grand scheme of things, I'd much rather see punks charged for shouting obscenities, wouldn't you?

you can bring a civil suit for damages, which in this case wouldn't be much if any. But you might be able to get a jury to give you punitive damages. But as the previous poster stated, you can't extort money with the threat of criminal charges. If the OP did bring a civil action, the civil action needs to be kept seperate from the criminal.

whether the OP brings a civil action, or presses the authorities to bring criminal charges, Identification will be a potential problem. From the license number, you can establish who owns the vehicle. Proving who drove it, and who swung the flip flop is another matter.

Battery is a harmful, or offensive, touching. Here the playful tap was clearly offensive.

Assault is an overt act that puts the victim in apprehension of a harmful or offensive touching.

It's actually a battery with the flip flop, and arguably an assault with a deadly weapon, the car.

Here's a stupid question; What's the difference? I always hear of "assult and battery" but all I know is that together it means you got hit and /or hurt. I don't understand what each one is separately.
