First, that's amazing that you got a response so quickly!
Second, there's some back-and-forth on the thread about my bike and crash right now.
There are a lot of ways to slice this one. Several of them are covered very well--by well-meaning and thoughtful people--on that thread.

I would minimum be riding a Madone after what you just went through
I am not a big fan of suing other people but get what you think you deserve.
Forget that Trek on back order. Time to upgrade to steel or carbon.
I was not kidding about riding a Madone...the least they can do.

they'll want to settle as soon as they can and will make you and offer for pain and suffering. this locks them out of paying out more if you sue the insurance company. if you're not injured badly (i haven't read your previous post) you could take a settlement now knowing that's all you'll get.
