While I don't condone anything that dumb motorist did... what I'm wondering is why you chose to confront someone who was so obviously antagonistic in the first place. Someone who would knowingly use his car as a weapon against a cyclist could just as easily have a gun... or use his car and not miss the next time around.
Sure, cyclists have the rights to the road, but sometimes you have to ask yourself: Would I rather be right... or alive?

This is a double-edged sword for me. I grew up in Oceanside and have ridden the beach areas a lot. I have since moved to LA. I am excited about the trails along the beach that have been completed and looking forward to more, but what i dont get is that the majority of cyclists don't use them, specifically the trail above buccaneer park and further south. While I am patient with cyclists along this route I think they are the ones that will keep more trails from being built. There is a part of a trail above Encin. Blvd that I don't see cyclists using either, I just scratch my head. verall [I] feel way more comfortable in San Diego than LA 10 fold. I, for one, want more trails please.

lol i actually live near that trail you are talking about(so does jerk off from the other night) and yeah i NEVER see any cyclists using it at all. the only time i ever see someone on the trail is some surfer dude on a beach cruiser. but yeah, the trail does suck though.. it doesn't go all the way through & then that point at Cassidy st where it just stops & then you have to cross the railroad tracks/street to get back to it the next block up is just.. 'what the hell were they thinking'

I tried that trail once. Not only is it only 3 blocks long, it's also only about 4 feet wide. The day I tried it, there was a guy with 2 dogs on a leash, another guy on his skateboard, and 2 people walking casually down it, taking up most of the space. Just the kind of place I want to be with a 'bent going 20 mph!
And the best part of all is how it dumps you into the street at Cassidy, where you're the last thing any car's going to be looking for.
It's a great example of how well-intentioned city councils need to call in some actual bicyclists before they spend all that money on a "bike trail".

Rather than vandalizing someone's property in retaliation for THEIR lawbreaking, you can simply make a "Citizen's Arrest":
Citizen's Arrest
A police officer may not arrest or cite a person for a MISDEMEANOR crime NOT committed in their presence (with very few exceptions).
A citizen, who saw the crime occur may make an arrest for a crime not witnessed by an officer. This is a citizen's arrest.
There are over 50,000 citizens living in the City of Santa Cruz. There are less than 100 police officers. Without the active participation of the citizens who act as the eyes and ears of the Police Department to report unlawful activity, the quality of life in our community would certainly decline.
People are often hesitant to get involved because they believe it is too complicated or someone else will report the unlawful activity. It is up to each and everyone of us to be involved. We set the community standard by our actions or inaction.

- Tell the police dispatcher you want to sign a citizen's arrest and you want to speak to the responding officer.
- If necessary, appear in court to tell your story, if requested by the District Attorney's office. (Most cases are concluded without the necessity of a court appearance.)
- In most cases, you do have to be in visual contact with the suspect to positively identify the law violator. This may be accomplished in a number of ways; face to face, talking to one officer who relays the information to another officer via radio or phone.
- Yes, in order for the officer to make an arrest for a crime the officer did not observe, the officer must contact the arresting party. In some cases, this contact may be by the officer via a cellular telephone, but not all officers have this capability. Person to officer is by far the best way.
- Over 90% of the cases are resolved without the necessity of a court appearance.
- What if I am not sure if I want the person arrested? You, as the person who observed the law violation, are the only person who can make the arrest. If you were concerned enough to call and expect the illegal activity to cease, you must get involved.
- A citation, or ticket, has the same legal implication as an actual physical arrest. The arrested or cited party must stop their unlawful activity and appear in court for the criminal violation.
- If you do not feel the incident was handled properly, or if you simply have a question, you may ask to speak with the officer's supervisor.
- I would encourage you to still call the police and ask them to respond, but if there is no one there who actually witnessed the unlawful activity, in most cases, an arrest cannot be made.
- How long it takes the officer to respond is directly dependent on the number of officers available and the severity of the incident(s) being reported at the same time. All calls are prioritized by severity and not by the order or time received. Emergency or high priority calls must be answered first. Ask the dispatcher, prior to hanging up, approximately how long will it be before an officer arrives. They can usually give you a rough estimate.

well i guess you can say there isn't much that scares me and i'm pretty hardened over a ton of past "experiences"(not necessarily bike-related). that and i'm a pretty big person who is also fairly quick & has taken various martial arts for over 20 years(including knowing about most of the pressure points on a human body). so sure, he may have a car & possibly a gun... but unless he actually does hit me or is able to get in a head shot, i'm pretty confident i'll be able to stand my ground & possibly even take 5-6 shots before i go down.

Those cops probably laughed their asses off as you rode way.

And why not? According to the opening post, the cyclist SAW the motorist commit a "public offense" -- in this case, probably a misdemeanor under the California Vehicle Code. I suspect "reckless driving" for forcing another vehicle off the road. The police didn't see it. But the cyclist did. However, if instead of simply complaining, he says he wants to make a citizen's arrest, then the officers can't just brush him off. They HAVE to follow through with the proper procedure. That's why I went and copied/posted the procedure. So people would know how it's done.
the other choice is to post a rant on bike forums and let the world know how upset this makes you. The motorist in question will never see it.

I guess on Krypton, when you make a "citizen's arrest," the person you're arresting simply submits and goes with you to the police station until the matter can be politely disposed of.
Here on Planet Earth, and particularly in some cities like Oceanside, Vista, San Marcos, and Escondido, that's a good way to find yourself in a world of hurt. The odds are that being harrassed by a motorist would be the least of your worries.
Of course, perhaps you're a trained martial artist, or carry a concealed weapon. In that case, perhaps you could manage just fine.

Again, this is why I posted the "how to" for making a citizen's arrest. You don't really have to physically apprehend the person and personally deliver them bodily to the police station. In fact, for legal reasons, let alone safety reasons, it is not recommended that you try to personally take an individual into custody. You call the police, and tell them you want to make a "Citizen's Arrest." They send an officer, and THEY issue a citation (which has the same legal force as an arrest), and YOU sign it. It's the same as if the officer had seen them committing the moving violation and pulls them over and issues a citation. The only difference, YOU sign it as the person who eye-witnessed the misdemeanor (instead of the officer), and YOU are the one who makes the court appearance at the hearing.
At least that's how we do it here on Krypton.

Damn I hate lazy cops. The guy used his multi ton vehicle as a weapon, and it's not considered threat on someones life?
i decided to ride my mountain bike to Boney's(a grocery store here) to get pick some incense & just barely made it there before they close(which is 9pm). on my way back home i was crossing at a green light(obviously had the right of way) & some guy in a white 3rd gen eclipse wanted to turn & i guess he felt he had the right of way or something & tried to go until he saw i was going & stopped to wait for me & then he yelled something(i couldn't make out what it was).
i didn't think anything of it and kept going. about 2 blocks up i see these bright ass headlights coming up behind me(his brights on) and it's him and he swerves toward me holding down his horn & i had to quickly swerve right myself, almost falling off of my bike. then wouldn't you know.. a red light up ahead and he's sitting there. i stop next to him and yell "what the **** is your problem?" and he says the same thing back to me & i said "i have the right of way just as much as you do *******!" and he just replied "no you don't!" and the light turned green & he sped off.
and guess what's next?.. i see where the ******* parks & know where he lives now.
anyway, i was feeling restless and no i didn't do anything to him/his car, but i passed by a 711 and as usual there were a few cops hanging out in the parking lot so i decided to explain the situation to one of them and the cop just said that since i didn't actually get hit or that the guy made a threat on my life that there isn't anything they can do, but assured me that if they saw it happen they would have pulled the guy over and taken 'appropriate action'.
great, thanks for nothing law enforcement.
i dunno, heck i remember when i was younger i used to be scared about riding my bike on the street & would just stay on the sidewalk until one day a cop stopped me & made a big deal about me being on the sidewalk and how i was supposed to be in the road & going on about traffic rules, etc.. so what the hell.
i just wish there was something we could do about people like this jerk from last night
