I'ver never looked up the exact law but from this video makes it seem like you must always be in the bike lane.

Holy cow, that is one of the most perfect pieces of sensationalist yellow journalism I have ever had the chance to read. I mean, the cold facts probably point to the cyclist being at fault, but wow, the phrasing, the diction, everything they can possibly stack against the cyclist. They spin better than a track champion.

That was my first thought also. Considering the hyperbole inherent in any NYPost article, it feels to me like this guy showed about the same disregard for pedestrians as your garden variety careless driver. But I wouldn't be surprised if they threw the book at this guy.

Two months ago, a female cycling advocate in NYC was hit by a car and put in the hospital. Witnesses identified the car, followed it to its destination, photographed the driver, and provided info to the police. The police have yet to follow up, so the advocate is suing them and the driver. This was all in the written news last week.
Five months ago, a cab driver hit a young boy walking across the road, dragged him to his death. NYC's initial response was to pull his hack license. National media attention got more legal attention focused.
Not excusing the cyclist, only saying that an expectation of jail time is presumptive. A presumption of a massive civil suit is far more likely.
