in the meantime to the op: i wouldn't do it myself. partly because i'm not interested enough in drinking or proving anything about my abilities ui to care if a few beers means finding some other way of getting home. but mostly because i think it would make me feel like a hypocrite: like i want all the privileges and rights of being a vehicle when i'm on a bike, but i'm not prepared to ante up the responsibilities in return.

I guess you've never heard a motorist say the same thing about their ability to control their vehicle while drunk?

I drink and ride. For me, it's a conscious decision NOT to drink and drive, and when I bike home after a few drinks I take back roads with little or no traffic (b/c I don't want to get hit by drunk drivers) and I use lights for visibility and a bell to alert pedestrians.

Biking intoxicated is illegal here (CO) and technically you can get a DUI that counts against your drivers license (which I think is absurd), but I do it with no harm or risk to anyone but myself, and I think it's the right thing to do. Drunk driving, on the other hand, is flat-out wrong and often murderous.

I gave up drinking about 30 years ago. I got tired of waking up in the bushes with a hangover. I don't find drunks clever or amusing.

There's a guy in my town who has gotten two HUI's in less than a year. Riding a horse down the street with a 1.8 alcohol reading (the rider, not the horse).

... which brings to mind that hilarious scene in "Cat Ballou" with Lee Marvin drunk on a drunken horse. I believe when he accepted the Oscar for his performance he said "That horse deserves this more than I do!"

Actually, Marvin's performance in that movie was a drunk I *did* find amusing...

"Saved" puritanical safety nannies who want to call the cops every time they THINK they see something that offends them are not so great either.

I assume the local law men wait specifically for that conspicuous (and likely sad sack) individual outside taverns to humor themselves while ignoring others leaving the tavern by more conventional means. Presumably they would not be targeting this individual if he drove off in an automobile instead of the "socially unapproved" method of transport. Please correct me if I guessed wrong.

My company, does random breathalizer testing. Mostly after lunch hour. We call in a crew and have them do their "cup thing" and take a breath test.
We also do it on Monday mornings before they begin work. If they show any reading, they are sent home immediately, without pay. They are class 2 drivers and also operate heavy equipment and work around high tension utilities.
It's amazing how many also get sent home the next day.

Safety first.

California's new law for commercial drivers says 0.04 BAL or more is a DUI regardless of what type vehicle the person is driving, on duty or off duty. This means a second beer is a potential DUI whether I am driving a 40 ton rig, my pickup truck or my bicycle. No more bicycle touring the Napa Valley/wine tasting for me. I don't get it.

You're aware that there's a pretty large middle ground between 'not drinking at all' and 'waking up in the bushes with a hangover', right?

For most people, yes. For me there wasn't. That's why I quit, and I don't miss it a bit.

It looks like the shift key on your keyboard is drunk. Sloppy punctuation is a capital offense.
