I sent the frame for the cost of postage. I was making no money out of it and was happy to see the frame being used by another enthusiast as I have far too many at the moment.


I'm reasonably sure I'll get the cost of postage refunded, but I'm trying to see if I'll get any compensation for complete destruction of a gift.

That makes it more difficult then, if there wasn't any purchase and payment and you didn't declare a value (probably not since that's only for more than $100). Come to think of it, for items >$100 I used to use third party insurance with UPS. Good luck.

PS that's specific to UPS. If you have another carrier, my observations won't apply. USPS for instance was actually more reasonable, if more paperwork hassle. Someone said "UPS" so that's what I was going on. Whatever you have there in the UK may be a totally different story.

The OP should get his bike shop to give an assessment in writing on what the frame might have been worth on the open market. A search of sales of similar frames or bikes on eBay might also be useful.

Good news to start 2013. Refunded in full, including my estimate of the value of the frame.

Sent lots of emails plus said that I would take it to Small Claims Court if not settled within one month.

Good news! At least the damage was obvious enough for a non-enthusiast to observe. FWIW I've used Fedex and USPS for bikes and frames respectively and both do a better job (not perfect but far less destructive) than UPS. UPS is also more expensive.

I also avoid UPS shipping when I buy retail items. It seems they make sure that the cheaper 5+ day shipping rates take 5+ days. Even with an item arrives at a local distribution site within a couple days they seem to park it there until the service level paid for is not exceeded.

I wish I could find an old post where UPS bent a 50's caddilac bumper into a U shape, now THAT takes some doing!! if it can be destroyed, they will find a way. If you dont care about it, send it by big brown turd

It's really good to hear that it has worked out for you. I've been following this thread for a couple of days.
I've got an interesting situation.
I bought a couple of bicycle parts on E-Bay.
A Campagnolo Record Front Deraileur clamp-on $15 and a Botranger steering stem $19.
I thought GREAT DEAL!!. The seller was supposed to do combined shipping $17.
Instead, this is how it played out. I got $17 shipping charged for EACH item with $4 off the total shipment.
This was all in the same box with the same shipping/tracking number.
I was not happy at all but thought that the 2 parts where still worth the hassle.
3 weeks later the box shows up.
I open it and all that is in it is styrofoam peanuts and nothing else.
The seller does not reply to my e-mails.
So far E-Bay and PayPal are stuck doing nothing because the seller is not replying to them either.
I can't beleive it. They have a tracking number for an empty box!!!

How many sales had the seller made, and what was the feedback rating?

Personally, I would have protested the shipping charge right off the bat... if it was indicated that combined shipping was specified in the listing.

Sounds like you have a case with PayPal for a total refund, however it may take a while.

I am disputing with PayPal and E-Bay.
I'm just TOTALLY numb that would happen.
I mean that I could never have thought of a ruse as diabolical.
Just really disappointed at what some people are capable of.
I got a good deal so lets sabatoge it?
At what line do you draw whith number of sales and feedback rating?
Oviously 100% feedback is good. But what about 97% or 94%.
Maybe we can have some feedback from folks on where we draw the line?
At 97% we don't buy from you? You're tainted?
I really want to hear from members on this.
And what about neutral feedback?
I'm almost at the point that I don't want to deal with E-Bay anymore.

How many sales had the seller made, and what was the feedback rating?

The seller had 403 sales and 97% rating.
He had 2 negative ratings . Also, one neutral rating all in last 7 months.

I haven't bought off eBay for over six months, and I have an Australian account, which means the pool number is a lot smaller and a lot easier to track down.

The seller's credentials certainly seemed to stack up. It may be that the seller is on holiday and after what he thought was finalising your transaction, hasn't logged back on to eBay yet. Although he should be getting the PM notifications on his email list.

Giving him the final benefit of the doubt, maybe he innocently thought he had packed the items. Plus, did the package look at all interfered with or obviously damaged when you received it?

Stick with it through Paypal and eBay. I used to pay via bank deposit as my default, but now use PayPal exclusively for these sorts of reasons.
