Cyclist struck by UPS van

I was stuck yesterday while riding. I was on the shoulder of a road going with a tailwind, traveling at around 25mph. I was passed by a UPS van who then turned right in front of me into a driveway without signaling. Tacoed my rear wheel but everything else is ok.

He gave me his name and supervisor's number. I told him the story. Now, I am being bombarded with calls from several insurance adjustors. I told an adjustor what had happened in a telephone interview today that was recorded.

What should I do next?

I'll email a friend of mine who went through a similar experience. He was at a stop light and all of a sudden felt his bike move lower and lower. He turned around and a woman in an SUV (who was on her cell phone) had hit his rear wheel and tacoed it.

They ended up buying him all new parts to replace everything that broke. Along the way the insurance adjustors tried to say "oh the wheel is a depreciable item so we don't have to pay you the replacement cost". He ended up arguing and eventually got 100% of what he asked for. don't be surprised if they try to dink with you.

Bikes: A few.

See a doctor. When you get repair/replacement estimates make sure you tell them to quote full retail price plus install and all costs related. Remember, once you accept a check or sign off on any paper they offer, it's DONE.

Did you suffer any injury? If not, demand they completely make you whole with regards to your bike repairs. I would have the frame checked over and measured for any damage which can easily happen due to high torque twist to rear end. YOu are darn lucky you did not get hurt. Good luck and let us know what happens.

Always good to go see a doctor and get checked out since it will be covered by the drivers insurance anyway. You don't want to settle on a deal and then learn your hip is out of whack. Glad you're alright and the driver actually swapped info with you.

Did you call the police to file an accident report? Most large fleet operators require a police report from their drivers if they are involved in an accident. Since this only happened yesterday, I would make the call right now. I'm sure they will ask you to come to the station to file the report.

Definately see a doctor before you talk to any insurance company people. I believe most states require you to file a police report in any auto accident causing injuries.

I still haven't settled the personal claim on my accident i was involved in in sept last year. I signed off on the physical bike replacement, but i haven't signed off on the personal injuries yet cause i want to makes sure i'm 100% better and there will be no residual or life long disadvantage cause i was hit.

DEFINITLY see a doctor, even something minor should be fully treated just to make sure.

Especially since it's a large company don't settle for something small, if you don't get what you want call, or threaten to call a lawyer and that will definitly up the settlment offer.
