Good job, OP. I had my MTN bike and my first fixed gear conversion stolen out of my locked garage last summer. Both bikes were locked up in the garage and they were still stolen. This happened in the middle of the night while I was watching tv. Had I looked out my back door before going to bed, I'd have probably caught them in the act. I'm not a very violent person, but I would have like to have had the chance to catch them in the act.
To the folks saying the OP shouldn't have held the theif down, the hell with that!

I see where Frank's coming from, but it's a naive position. No one likes having the things the own taken from them.
Most people, upon witnessing someone walking off with something of theirs that they really like are going to respond by cracking the guy in the skull with whatever happens to be handy. I think that those who thieve have a general understanding that this is the kind of response they risk by acting so immorally.

yeah, I'm back... you idiots provide too much amusement to stay away forever. I have to say I'm a little disappointed I didn't even get a profile infraction...
I'm not that thrilled about the throttling either... you let him walk 20 feet down Magazine with your bike? You sure you weren't looking for the thrill of subduing the guy post-bar? Don't get me wrong... stop the guy, put your hands on him to do so... but the hands around his throat part...?
Perhaps my favorite part of this thread is the laughable notion that NOPD are appropriate decision-makers when it comes to the use of force. Anyone who lives here or has lived here should be able to see the insanity in that idea.
And yes, OPP still has guys in tents, and in all likelihood, unless the guy knew no one at all in the city and had no local address whatsoever, he was out on bond the next evening (if not before that, some people manage to get out before the bond hearing), depending on whether he had priors. There was no violence involved, the bond would probably be fairly low.

And no. I am a 40 year old professional, with a too much to risk to be getting into post-bar fights. No thrill whatsoever.
And I wholeheartedly agree about the NOPD officers not being the best decision makers on excessive force.
But in this case, it was a non issue, no decision to be made. I hadn't intended to injure the guy and I didn't. My bark was quite a bit worse than my bite.

True BB, you didn't say throttle or choke, but you did say you grabbed him by the throat; which does sound, to someone not there, a good bit like throttling (to some extent, using force to hold-onto someone with your hand across the front of their throat is likely to limit the their ability to breathe, although it may not involve intent to limit airflow); as opposed to holding someone by the back of their neck, which doesn't sound like throttling at all.

was gripping him by the throat really necessary? I mean, sure he was trying to lift your bike, but that doesnt make it chill to grab him and throw him to the ground by his throat...thats assault, you should have just grabbed his shoulder and held on until the cops came.

As an update to this resurrected thread....I still haven't heard from the DA yet after nearly 3 weeks, which is what my attorney told me to expect. Who knows, maybe the cops drove him around the corner and let him go, or the DA just pled him down to lesser charge, figuring that they had better things to do than waste too much time on a bike thief. Either way, it certainly ruined his night and hopefully scared the SHIITE outta him.
