got doored today...
i tried searching but didn't see anything, and it never hurts to have this sort of info on the front page, i was doored this morning on my way to work, i rode in the ambulance, there's a police report, i have his insurance policy# and the police have his license plate, what am i able to get covered? i know that new york is a no fault state so my hospital bill is covered but where am i in terms of the missed day of work damage to my bike?

Call a personal injury lawyer and find out what you can/should do. Also, your insurance company should be able to advise you. It's pointless to ask questions like this on a public forum.

It's not completely pointless to post this here, as a very high percentage of us are city cyclists, and have dealt with this before. When I got doored, I called up Stuart Leon, who is a bicycle specific attorney based here in Philly. I'm sure there's a similar firm or attorney in NYC. It helps to have someone that works specifically with cycling, as they know the specific laws and loopholes. How about this guy?
In my case I got repairs to my bike paid for, and some extra for minor injuries. Don't talk to the other party's insurance claims adjuster before talking to a lawyer, or at least don't agree to go on record.

Hmmm Bicycle lawyer ehh... BOOKMARKED! I feel i'm due for a dooring or two. Have luckily and skillfully (mostly luck) avoided the doors and cars.

I'm guessing that since you're in the BK, you have no car, therefore no auto insurance? The responsible party's insurance should be covering all your medical bills, as well as any property damage. Not sure how it works missing a day's wages, but there is probably a threshold that needs to be met before you can pursue a settlement. And much as I hate to admit it, you should seek out a free consultation with an attorney.

i'm sorry i came across as a dick, i'm sorry this isn't a thread about matching my risers to deep vs to my chain to my spokes, i would rather not involve a lawyer if i don't have to, i'm not anti lawyer i just think they have their place and time and frankly making a little money off a standard insurance claim is not one of them,
i know other people on here have dealt with insurance, in the years i've been a member of bike forums i've posted only a handful of times anywhere but the ssfg, i know i've seen similar threads on this forum and though i couldn't find them i figured someone would be able to share their experience
sorry if you're upset that i posted here, like i said i think it's good to have this info available for people that don't yet need it to see it and this isn't an issue of advocacy or safety, this is an issue of dealing with some insurance BS and i was hoping someone here would be able to share, thanks for those with helpful answers, i'm checking out those links now

For the record, I'm not suggesting that you hire, or even need an attorney. But since you don't have insurance, it would benefit you greatly to have someone explain your rights, as well as the claims process.
The property damage adjuster for the responsible party's insurance will probably treat you fair. It's the injury adjuster that's going to be fighting with you.

I was hit last year by a city truck, Here is my advice...
1. HIRE A LAWYER, YES!!!! I settled on my own with the city and had all my property paid for. My auto insurance covered ll medical bills form the accident. But since I settled without counsel, I was unaware of a few things.
I know have a long term and permanent injury due to a torn bicep tendon. Because I waived my rights at the time of settlement, I am screwed getting any medical stuff covered.
I thought after a few months that everything was OK, so I settled. After going back to the gym I found out about my injury (short story).
2. Seek legal advice even if its only from a friend.
3. Have all your paperwork, recipes and replacement cost for the insurance company when ready to present it. DO not settle for the items worth, but get REPLACEMENT value.
Have your boss verify pay, time missed etc. You can get compensated in most states.
4. I hope your bike had brakes.

Now back to the subject at hand, get a lawyer....You may not agree with using a lawyer for this but you will be happier in the long run. Its just good insurance to make sure everything is done properly. Get receipts for full replacement cost of parts on your bike that need to be replaced, get a letter from your boss stating lost pay from the accident, pretty much everything everyone else on here has said. It sounds like a pain i the ass, it is a pain in the ass but this is to insure everything is dont completely and properly. You dont want to end up having to pay out of pocket in a few months because everything was not taken care of.
Best of luck with this ordeal, I hope everything works out for you....keep an eye out for those doors now...

as someone who works in the legal field, I can tell you that at least doing a consultation w/ an attorney will help you greatly here. I think the personal injury guys do free consultations, but don't quote me on that. I know we don't, but it's a different business. Good luck, I imagine you will be able to get all of your expenses paid for.

Part of the reason that NY state car insurance is so expensive is that all motorists are paying into a pool of money for the hit and run incidents. You should get the police report ASAP and contact Transportation Alternatives to recommend a lawyer. There is a fairly tight time line (30 or 90 days) to file the paperwork to seek recovery.
