Driver was charged with DUI. It doesn't appear that he was charged for any driving infraction. 3 AM, so I wonder what sort of lighting equipment the cyclist was running (if any)

Clearly the driver was wrong and his impairment certainly played some part in the incident, but to what extent? Assuming that the cyclist was readily visible, I would say that the impairment caused a significant lapse in judgement. If the cyclist was not running lights, then perhaps even an unimpaired driver may have made the turn.
It's starting to be less dark in the morning now, but I thought about visibility on my way into work this morning. I have a decent lighting set up and have noticed that most cars will yield to me. Because of this experience I started to assume that they all will yield. And then I thought that this was a very bad assumption to make.
