My point is you keep pointing out that they left the scene which is reprehensible but IF the accident was your fault what difference would it have made for your bills etc. if the driver had stayed. Your bike would still be totalled(although maybe not impounded), your bills would still be unpaid and your teeth would still be ****ed up, AND you could have gotten a ticket if the driver told the cop thier side of the story.

Also see the thread about whose responsibility is riding safe. This is exactly where taking responsibility for your own recklessness comes in.

have you considered calling around to the auto body shops in the area, asking if they've seen any silver cars/trucks/suv's come in with damage and who wasn't filing an insurance claim?

I don't know about SF, but NYC (perhaps NY State) is no fault. Driver's insurance pays, so in such a case the driver leaving would matter irrespective of whose fault it was.

If he cares more about the look of his vintage bike and speed then his safety he gets no sympathy from me when his recklessness gets him hurt. There are plenty of people who actually are riding legally and reasonably safely and still get creamed by cars. **** like this makes rightly makes everyones default expectation that the cyclist was at fault.

We'll I cant answer that, because I hit my head and don't really remember the accident. Maybe I'd be able to answer that question if they'd stayed and been able to tell their side of what had happened.

You are arguing a moot point. I am not blaming them, and I have taken responsability for my own actions. I'm not after this mystery driver, its a waste of my time and energy AND a lost cause, I just want to get better and get back on a bike.

dutret clam down. i got creamed a couple month ago, riding legally, person took off, i blacked out and recall very little about the accident and cant remember anything about the vehicle who hit me. so whats the difference between my situation and 128's? looks like it doesnt matter whose fault it is, the driver in a bike-car crash is going to take off.

dutret, have you considered the possibility that the driver was under the influence? that would be one reason why someone would speed off after hitting someone.

Indeed I have, I even mentioned that as a likely cause. 128 was still running through an intersection and still at fault. In any ethical sense two drunks pretty much equal each other out as far as the drinking goes.
