Well, that's a no brainer.

My purpose of posting was to share my morning adventure with my fixed-gear brethren. I know with them, they are going to be more concerned with my well being (and cool pictures) than with the rules and regulations of the road. Not expecting the advocacy and safety police to bring their soapboxes into our little hole in the wall, I did not lay out all of the evidence in a three page play-by-play, because I knew most folks would not give a ****. Next time, I still won't.

Not one fixed-gear rider, and they come in all shapes, sizes, and socio-economic categories, laid blame either in the forum or through PMs. For that, I thank you all and am proud to be counted in your number. The others can blow me.

[edit: exception to the rule: TrevorBoston guy. Oh well.]

Wow - are fixers an anthropological (sp?) dig now?

And is it a fixed trek?

Lose the front brake. Obviously it doesn't stop you in time. Learn to avoid and swerve. Brakeless is the way to BE with a capital B... I do hope you heal fast, but riding past the accident fast is better. Develop that psychic 'what traffic is doing for three blocks around me' sense...

If you have it I'm sorry - but moving is better than stopping, or running into cars.

here's a bit of insight:
stuff your law and insights up your <edit>. Schiek was in an accident. Schiek's bike is RIP. Schiek is not. Schiek informed us of the incident, with a well-layered, humorous patina. Some people cannot see patinas and feel it is their job to shake fingers and act parentally. These people should go away.

Uh, it's the fixed forum... We seemed to post stuff that has broader range and more scorn... I don't know why it matters either.

(I'm really surprised I can almost type

I guess mainly I wanted to know that it wasn't someone riding a road bike or MTB or something giving advice on stopping to a fixer, since they are such different beasts...

I don't know WTF I'm talking about anyways - half bottle of Jameson down the gut... I think I mistakenly added you into that reply... I think it was mainly the 'safe distance' argument - I didn't find that workable at all....

Glad to hear you're ok. Glad to hear you've already got a back up bike to run/bike with. May your bruises and sore muscles heal fast!

Now, where is the detailed illustration of the intersection, the van, the car and you? Without this info, all the newbie posters who joined this forum after the Kryptonite shenanigans, are gonna be advocating and safetifying all our asses forcing us to put gears, reflectors, horns, bright orange safety vests and front and back brakes on all our rides!

I hope you still got checked for injuries, even if you don't seem to be injured. Some nasty (internal) stuff can happen in crashes.

Whatever, chief. I'm not tuned into the truth station so I must've missed an important announcement. Next time I'll make sure that I don't discuss any details of any accident lest I find myself on the wrong side of someone's bad attitude.

If you noticed, I joined our discussion in full swing. The topic at hand seemed to be whether a rider in this particular situation would or would not be declared at fault and and eligible to pursue damages. Maybe it was a throwaway comment, maybe I shouldn't have taken the bait, nevertheless, that was the topic. (Actually perception of the situation shifted in the course of the discussion, but then that's what a discussion is for, right?)

And for the record, I didn't blame Schiek for the accident. I said he was probably at fault based on the initial description of the accident. That's a legal opinion (from an admitted non-expert) which is can be greatly at odds with the concepts of fairness or real-world blame. Even if the accident had happened as I initially understood it, I wouldn't blame person driving/riding the trailing vehicle though in just about every case the judge would find them at fault.

Damn, people can't just talk about stuff. Everything's gotta be some sort of pissing contest. WTF.

hey, i'm with you bostontrevor. you made the mistake of trying to analyze an event and then posting your thoughts on what happened. that seems to be a big no no on this forum sometimes. i guess your supposed to pat everyone on the back and whisper the same reassurances that everyone else does. sorry you got chastised for using the forums as they were intended....to speak your mind and share your opinions. i didn't realize this thread was supposed to be a hallmark card either.

If the car had come to a braked stop, and Shiek was following so close he couldn't safely come to a stop behind it, then he'd be at fault. But the car very likely came to a much quicker stop than it could have using brakes instead of van as stopper; there's no reasonable way he could have anticipated such a stop; he's not at fault here.

Most people know the saying "when you assume you, you make an ass out of you and me". Some people made assumptions in their assessment of the accident. Me thinks Schiek played them like a trophy marlin.

People chastised me, people got chastised back. Works both ways, right? Under your rules, I can't respond to critics or call them *******s when I think they are out of line for "assuming facts not in evidence"? I don't like those rules.
